Fairmont Rear Ending Accident

On February 24, 2009 Dino Colombo, from the law offices of Colombo & Stuhr, represented Charles Berry in a trial in Morgantown, Monongalia County, WV. Mr. Berry, a resident of Fairmont, Marion County, WV, was injured when he was rear ended by a careless driver in Morgantown. The Defendant was insured by State Farm Insurance Company.

Mr. Berry suffered a herniated disk in his cervical spine which caused him permanent neck pain and cervical stiffness. Mr. Berry’s treating chiropractor testified that his neck pain and reduced range of motion in his neck was permanent and was caused by the rear end accident.

State Farm took the unreasonable position that this was a minimal impact accident and only offered $10,000 on the day before the trial began. Mr. Colombo & Mr. Berry rejected this settlement offer.

After 2 days of trial the jury returned a verdict in Mr. Berry’s favor and awarded him in excess of $400,000 for the herniated disk in his neck and for his pain, suffering and loss of enjoyment of life.
