Morgantown Man Suffers Brain Injury

Mr. Colombo represented a Morgantown man in a medical malpractice case against a Morgantown hospital for events that took place following cardiac bypass surgery. The client had cardiac bypass surgery with no complications. The client had been moved from the intensive care unit to step-down but was having some respiratory distress and was receiving oxygen through a face mask. For reasons the hospital cannot explain the client’s face mask was removed or had fallen off and the client went into respiratory arrest. Even though the client was on a continuous heart monitor the nursing staff failed to timely recognize the respiratory distress which went on for several minutes. Eventually the respiratory arrest was discovered and cardiopulmonary resuscitation (CPR) was successful in reviving the client.

Unfortunately, because of the respiratory arrest and the delay in recognizing this emergency the client went on to have a significant brain injury.

A medical malpractice lawsuit was filed in Morgantown, Monongalia County, West Virginia. After a period of discovery with numerous depositions taken the healthcare providers confidentially settled this case.
