Morgantown Man Suffers From Respiratory Distress

Dino Colombo recently represented a Morgantown man who in December 2007 underwent a mini-maze procedure at a hospital in Morgantown. The mini-maze procedure was being performed as the patient had chronic atrial fibrillation. The mini-maze procedure was designed to surgically correct the atrial fibrillation.

Unfortunately, the cardiovascular surgeon who performed the mini-maze procedure negligently injured the client’s phrenic nerve. As a result of the phrenic nerve being injured the client’s right diaphragm was paralyzed leaving the client with permanent and significant respiratory distress.

The client went on to have plication surgery at the Cleveland Clinic Foundation to relieve some of his respiratory distress. The plication procedure moderately improved his respiratory status and the client continues to have significant respiratory compromise.

A medical malpractice lawsuit was filed in Morgantown, Monongalia County, West Virginia. After several depositions were taken the healthcare providers confidentially settled the claim with the client.
