Oak Hill Man Suffers Severe Spinal Cord Injury

Mr. Colombo represented a 35 year old gentleman who developed cerebral palsy at approximately 11 months of age. For all of this gentleman’s life he suffered problems associated with cerebral palsy such as severe cognitive deficits, inability to speak, vision difficulties, learning disabilities and difficulties walking or ambulating. He was cared for in his home in Oak Hill, WV by a home health agency that provides home health services in Bridgeport, Clarksburg, Fairmont, Fayetteville, Morgantown, Beckley and throughout North Central WV.

What occurred in this particular case is truly a tragedy. A female home health worker inappropriately took the client out of his house to her house for personal reasons. The home health worker did not have the permission of the client’s guardian or her supervisor to remove the client from his own home. While at the home health worker’s residence the patient fell and suffered a spinal cord injury. The spinal cord injury resulted in the client having quadraparesis which resulted in the client being a functional quadriplegic. In other words, the client had a severe and permanent spinal cord injury and was confined to a wheel chair.

After extensive discovery it was determined that the home health worker had lied about the facts and circumstances surrounding the client’s fall. There was also evidence that the home health agency itself attempted to cover up the facts and circumstances of this injury. A substantial but confidential settlement was reached on behalf of the client.
